Terms of Use

Welcome to Peapod. These Terms of Use govern your access to and use of the Peapod mobile application and related services. By creating an account or using Peapod, you agree to these terms. Please read them carefully.
1. Eligibility
You must be at least 13 years old to use Peapod. By using the app, you represent that you are 13 or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly allow users under 13 — if we discover an account belongs to a child under 13, we will terminate it immediately.
2. Your Account
To use Peapod you must create an account. You are responsible for:
- Providing accurate and truthful information when registering.
- Keeping your login credentials secure and not sharing them with others.
- All activity that occurs under your account.
If you believe your account has been compromised, please use the Contact Us screen in the app immediately.
3. Private Circles
Peapod lets you create and join private circles — small groups of people you know and trust. You control who you invite into your circle. By inviting someone, you take responsibility for ensuring they are a person you genuinely know and that they meet the age requirement.
Do not use circles to share content with people without their knowledge or consent.
4. Acceptable Use
You agree not to use Peapod to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene.
- Share content that exploits or harms minors in any way.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Upload malware, viruses, or any code designed to disrupt or damage the service or other users' devices.
- Attempt to gain unauthorised access to any part of the service or another user's account.
- Use the service for any commercial purpose without our prior written consent.
- Scrape, copy, or redistribute content from other users' circles without permission.
5. Your Content
You own the photos, videos, and other content you post to Peapod. By posting content, you grant Peapod a limited, non-exclusive licence to store, display, and deliver that content solely to the members of your circle, as necessary to operate the service.
We do not use your content for advertising or sell it to third parties.
You are responsible for ensuring you have the right to post any content you share — including photos or videos that feature other people. Obtain consent from anyone identifiable in your posts, particularly minors.
6. Content Removal
We reserve the right to remove content that violates these Terms or that we reasonably believe is harmful, without prior notice. Repeated violations may result in account suspension or termination.
If you believe content posted by another user violates these Terms, please use the Contact Us screen in the app.
7. Privacy
Your use of Peapod is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Peapod, you consent to the collection and use of your information as described in that policy.
8. App Store Terms
If you download Peapod through the Apple App Store, your use of the iOS app is also subject to Apple's Licensed Application End User License Agreement. Peapod is licensed to you, not sold, and your App Store license applies only to your use of the app on Apple-branded devices you own or control, as permitted by the App Store usage rules.
9. Intellectual Property
The Peapod name, logo, app design, and all related software are the property of Peapod and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Peapod service without our express written permission.
10. Disclaimers
Peapod is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure.
To the fullest extent permitted by applicable law, Peapod is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
11. Termination
You may delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms, with or without notice.
Upon termination, your right to use Peapod ends immediately. Provisions that by their nature should survive termination (including content licence, disclaimers, and limitation of liability) will do so.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email before changes take effect. Continued use of Peapod after changes become effective means you accept the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of Peapod will be subject to the exclusive jurisdiction of the courts in the jurisdiction where Peapod is headquartered.
